Single Vehicle Rollover Accidents

Rollover accidents represent a unique segment in car accident injury law. These types of accidents are unique in the sense that they are one of the few versions of single-vehicle accidents where the driver is not almost certainly to blame and require a savvy auto accident attorney. Often, single-vehicle rollover accidents are due to defects rather than driver error.

Rollover accidents are very common in Houston, Texas primarily due to the popularity of the SUV as the car of choice. By default, SUVs put drivers at considerable risk for single vehicle roll-over accidents due to their high center of gravity relative to their narrow track (transverse distance between the center line of one tire and it’s counterpart on the other side).

This high center of gravity creates an opportunity for routine collisions, abrupt maneuvers, and road undulations or imperfections to result in the vehicle rolling over. This is compounded by the fact once the SUV does roll, the roof structure is often lacking in structural support capable of sustaining the mass of the up-ended vehicle. This leads to the head and spinal cord trauma that has become synonymous with rollover accidents. SUV’s are often determined to be insufficient at adequately protecting occupants to a reasonable degree of safety, and many product liability cases may be brought against the manufacturer in the event of such an accident.


Defective Tires

Another common contributor to rollover accidents is defective tires. While tire defects are often caused by poor maintenance, a considerable contributor to tire failure is negligence during the manufacture of tires or the selection of inadequate tires for a vehicle by either the manufacturer or tire dealer. In the case of an SUV with its natural proclivity to roll over, a defective tire makes a bad problem worse.

The mother of a young man hired our firm to investigate the death of her son following a fatal car accident. The incident occurred as one of the two vehicles involved ran a red light and drive into the path of the other. The defendant was driving a work vehicle for a construction company. The defendant survived the accident and stated to police that the decedent caused the accident. The police could not conclusively determine who was at fault, yet the police report strongly implied that the decedent was likely at fault based on the statement provided by the defendant.

The plaintiff's mother was not convinced. Through a thorough investigation, we ultimately determined that the stoplight that the defendant claimed that our client ran, in fact, worked on a timer whereby the light was always green between certain hours unless a vehicle traveling on the intersecting road had been stopped at the right light for more than 30 seconds. Based on an analysis of the vehicles and tire markings, it was conclusively determined that both vehicles were traveling at the speed limit, which clearly indicates that the defendant driver had not accelerated from stop, rather, he was traveling at the speed limit, which would not have triggered a green light for the defendant.

The logical implications of this information is that the light could not have been red for the plaintiff, and it certainly would have been red for the defendant. As a consequence of this information, the case was resolved through litigation.
