Most personal injury disputes are resolved outside the court room. Trial is expensive, time-consuming, and most people will do whatever they can to avoid it. To that end, alternative dispute resolution (ADR) is an option for resolving a legal dispute without it going to trial.
These types of resolutions are governed by the Texas Alternative Dispute Resolution Procedures Act. For many cases, ADR is preferable over going to trial. There are a number of different types of ADR (most common are mediation and arbitration) but they all generally follow the same procedure: the plaintiff and defendant parties meet with a neutral third party and discuss their dispute. The third party then helps the plaintiff and defendant reach a solution upon which both parties can agree.
