In a series of events proximate cause may be the first, the last, or somewhere in between. Example: Driver A is speeding on the highway and consequently crashes into Driver B, breaking Driver B's leg and causing extensive damage to Driver B's car. The proximate cause of this injury and property damage would be Driver A's reckless driving. To put this even more simply, Driver B most likely would not have been injured had not Driver A been speeding dangerously.

Many accidents occur, however, where the issue of probable cause is not so easily apparent. To understand this better, let us look at a drunk driving accident scenario. A drunk driver crashes into another motorist, who dies from his injuries. One might assume that the drunk driver was the proximate cause of the motorist's death. If, however, the drunk driver had been at a bar earlier, then proximate cause would shift to the bar. The bar and the negligent bartender served the driver, allowed him to become drunk and then allowed him to climb into his car and speed away. Basically, the bar facilitated the driver's drunkenness and should be viewed as the proximate cause of the accident. By way of Texas dram shop laws the plaintiff would thus be entitled to sue the bar for damages.
