Mediation is one of the ways in which a fair out-of-court settlement can be achieved for an injured plaintiff. The following short article further explains the process of mediation in a Houston personal injury case.
Mediation is a method of alternative dispute resolution that can be employed when a case cannot be settled by phone or written correspondence. It is a second step that is often taken in personal injury cases in Texas before a trial case is considered. Mediation occurs when the opposing parties’ legal representation meets, in person, with each other and with an unbiased mediator. Once each side has had reasonable time to investigate the case at hand, they will meet with each other on behalf of their respective clients. A mediator will also be present, and such a mediator is often a retired attorney or a former judge.
The mediator is an unbiased third-party that listens to the arguments as presented by both sides. The mediator will then meet individually with each side, listening to their further arguments. The mediator then goes back and forth between each side, sharing the information he or she has learned, in an effort to get the two parties to arrive at a mutually agreeable outcome. The length of the process is dependent on quite a large number of factors. While some mediated cases result in a quick and fair solution for both sides, others result in a dead-lock, where neither side is willing to compromise in order to reach an agreeable solution. In these instances, a trial case will then be necessary. However, for those cases that are able to be mediated before trial, a plaintiff will likely stand to be fairly compensated for their injury without having to step foot into a courtroom.
