I recently represented a Houston family who lost their parents when the opposing driver’s tire exploded due to a defect in the tire. These types of accidents are especially frustrating because they seem so easily preventable.

A number of years ago I represented the family of a young man who was killed, we alleged, by another driver who had run a red light. The defendants contended that the young man ran the red light. The police report was unclear with regard to who ran the red light. There were many pieces of evidence our expert used to reconstruct who most likely ran the red light.

Evidence was obtained from the City of Houston which told us the type of light sequencing device that was used at that particular intersection. We also downloaded the modules in both vehicle that told us the rates of speed five seconds before impact as well as four, three, two, and one second before impact. The module told us about brake usage and cruise control.

Our expert went to the intersection at 2:30 in the morning when our accident took place to get an idea of the amount of traffic flow. The expert took detailed measurements and compared them to the measurements from the fatality report obtained from the Texas Department of Public Safety.

Depositions were taken of the defendant driver, the police officer who investigated the accident, all witnesses, and the defendant’s expert. The vehicles of both the plaintiff and the defendant were kept in storage for later inspection by the expert.

(policy limits) A husband and father of three was killed when the driver of an 18-wheeler veered into oncoming traffic, striking the young man's vehicle and several others. The defendant was employed by a small construction company that operated only a single 18-wheeler. As such, the defendants were largely underinsured and were not financially solvent.

Furthermore, the defendants had an eroding insurance policy and numerous other parties were intent upon filing claims of their own since the 18-wheeler struck multiple other vehicles. This created the need for an aggressive and rapid response before the other claimants could erode the policy.

Defense counsel made it clear that they wished to litigate the case despite the insurmountable liability arguments that our attorneys presented. They intended to designate a third party as a responsible defendant since the accident happened in a construction zone, even though it was abundantly clear that the construction zone played no role in the crash.

Additonally, the defendants made it clear that they wished to downplay the extent of the damages by virtue of a character assasination on the decedent.
